Employee-to-Employee Leave Donation

Bargaining unit employees are now eligible to donate their accumulated annual or sick leave to another bargaining unit employee at UMD who is faced with their own or immediate family member’s serious health condition as defined by the Family and Medical Leave Act. (AFSCME MOU: Article 13, Section 22)

SPECIAL NOTE: Any employee requesting leave from the UMD Employee-to Employee Leave Donation Program has a responsibility to find their own “donating employee” within the UMD Institution.  Over the lifetime of an employee's career, an employee may not receive more than 800 hours of donated leave. 

Employees donating leave to other employees:

• May voluntarily donate unused annual or sick leave to another employee within the UMD institution. 

• Must have a leave balance of at least 176 hours after the donation is deducted. 

• Designate the recipient of the leave. 

• The maximum amount of leave that can be donated per calendar year is 96 hours. 

• If an employee who receives leave does not use all of the donated leave, the remaining hours of leave shall be restored to the employee(s) who made the donation.

(1) Complete Form - Donating Leave.

(2) Submit the form to UHR Leave Management via UMD Box, or secure fax (301-405- 5885).

(3) Provide a copy of the form to the employee to whom you are making the donation. 

Employees receiving leave from other employees must:

• Have at least 180 days of UMD, USM or State of Maryland service. 

• Have exhausted all available annual, personal, sick and compensatory leave. 

• Need leave due to a serious health condition (SHC) as defined by the Family Medical Leave Act (FMLA) for: 

     1) the employee’s own personal illness or injury; or 

     2) a family member’s SHC for whom the employee is needed to provide direct care 

• Provide sufficient medical documentation to substantiate absence for the time period covered by the Employee-to-Employee Leave request. If medical documentation has already been provided for FML or ADA purposes, please indicate that on the request form.

• Not be receiving Accident Leave or Total Temporary Benefits (TTB) by the Workers’ Compensation Commission • Have received no more than 800 hours of donated leave from the Employee-to-Employee Leave Donation Program.

• Return any unused leave to the employee who donated (in the reverse order recorded.

(1) Complete Form - Receiving Donated Leave.

(2) Provide a copy of acceptable medical documentation that addresses the absence requested for the use of the Employee-to-Employee Leave Donation Program.

(3) Submit the form to UHR Leave Management via UMD Box or secure fax (301-405- 5885).
